Important Notice

Please read these Terms of Service carefully before using our services. By booking pet transportation services with Express TrackPaws Logistics, you agree to be bound by these terms and conditions.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Express TrackPaws Logistics ("Company," "we," "us," or "our") regarding your use of our pet transportation services.

By accessing our website, requesting a quote, or booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

2. Services Provided

Express TrackPaws Logistics provides professional pet transportation services, including but not limited to:

  • Ground transportation of pets in climate-controlled vehicles
  • Air transportation coordination for pets
  • Flight nanny services for in-cabin pet travel
  • Door-to-door pet delivery services
  • Real-time GPS tracking and welfare monitoring
  • Documentation assistance for pet travel

Services are subject to availability and may vary based on route, pet specifications, and regulatory requirements.

3. Booking and Payment

3.1 Booking Process

To book our services, you must provide accurate information about your pet, including species, breed, age, weight, health status, and any special requirements. Failure to provide accurate information may result in service delays or cancellation.

3.2 Payment Terms

  • A deposit of 50% is required to confirm your booking
  • Remaining balance is due 48 hours before scheduled pickup
  • Payment can be made via credit card, debit card, or bank transfer
  • All prices are in US Dollars (USD)
  • Prices do not include veterinary services, health certificates, or customs fees unless explicitly stated

3.3 Price Adjustments

Prices are subject to change based on fuel costs, route modifications, or additional services requested. We will notify you of any price changes before they take effect.

4. Cancellation and Refund Policy

4.1 Customer Cancellations

  • More than 7 days before pickup: Full refund minus 10% processing fee
  • 3-7 days before pickup: 50% refund
  • Less than 3 days before pickup: No refund
  • No-show: No refund

4.2 Company Cancellations

If we cancel your service due to circumstances within our control, you will receive a full refund. We are not liable for cancellations due to weather, natural disasters, government restrictions, or other force majeure events.

5. Pet Health and Safety Requirements

5.1 Health Certification

You must provide:

  • Valid health certificate from a licensed veterinarian (issued within 10 days of travel)
  • Proof of current vaccinations (rabies, distemper, parvovirus, etc.)
  • Any required permits or documentation for interstate or international travel

5.2 Prohibited Conditions

We cannot transport pets who are:

  • Seriously ill or injured
  • In the final trimester of pregnancy
  • Under 8 weeks of age (unless accompanied by mother)
  • Aggressive or pose a safety risk to handlers
  • Not properly vaccinated or lacking required health documentation

5.3 Medication and Special Needs

You must provide clear instructions and sufficient medication if your pet requires medical care during transport. We will make reasonable efforts to administer medication but are not liable for missed doses due to unforeseen circumstances.

6. Liability and Insurance

6.1 Our Liability

We maintain comprehensive insurance coverage for all pets in our care. Our liability is limited to the declared value of your pet, not to exceed $5,000 per animal unless additional insurance is purchased.

6.2 Customer Responsibilities

You are responsible for:

  • Providing accurate information about your pet's health, behavior, and needs
  • Ensuring your pet has appropriate identification (collar tags, microchip)
  • Providing suitable carriers, leashes, and supplies as required
  • Disclosing any behavioral issues or medical conditions

6.3 Limitation of Liability

We are not liable for injuries, illness, or death resulting from pre-existing conditions, undisclosed health issues, force majeure events, or actions beyond our reasonable control. Our total liability shall not exceed the amount paid for the service.

7. Delivery and Delays

We provide estimated delivery times but cannot guarantee exact delivery schedules due to factors beyond our control, including weather, traffic, mechanical issues, or regulatory delays. We are not liable for consequential damages resulting from delivery delays.

If significant delays occur, we will notify you as soon as possible and provide updated arrival estimates.

8. Customer Conduct

You agree to:

  • Provide truthful and accurate information
  • Treat our staff with respect and courtesy
  • Comply with all applicable laws and regulations
  • Not interfere with our operations or safety protocols
  • Be available at designated pickup and delivery times

We reserve the right to refuse service to anyone who violates these terms or engages in abusive or threatening behavior toward our staff.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Express TrackPaws Logistics and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Dispute Resolution

10.1 Informal Resolution

In the event of a dispute, you agree to contact us first to attempt an informal resolution. Most concerns can be resolved through direct communication.

10.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Walnut Creek, California.

10.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action must be brought in the courts of Contra Costa County, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
